Canada’s Start-up Visa (SUV) program is evolving to better support entrepreneurs. As of October 3, 2024, Immigration, Refugees and Citizenship Canada (IRCC) will allow eligible SUV applicants to obtain open work permits while their permanent residence applications are being processed. This change removes the previous requirement for employer-specific work permits, providing greater flexibility for entrepreneurs looking to establish their businesses in Canada.

What Has Changed?

Previously, SUV applicants could only apply for employer-specific work permits, which restricted them to working for their designated start-up. With the new update:

  • Eligible SUV permanent residence applicants can apply for an open work permit.
  • This permit allows them to work for any employer in Canada while waiting for their permanent residency.
  • Applications submitted before October 3, 2024, will still follow the employer-specific work permit rules.

Who Can Apply for an Open Work Permit?

To qualify for the open work permit under the SUV program, applicants must:

  • Be deemed essential to the start-up’s operations.
  • Have a pending permanent residence application under the SUV program.
  • Submit their work permit application online to IRCC under administrative code A77.

Key Benefits of the Open Work Permit

This policy update brings several advantages:

  • More Employment Opportunities – Applicants are no longer restricted to working solely for their start-up.
  • Reduced Financial Risk – Entrepreneurs can seek other work to support themselves while developing their business.
  • Improved Processing Efficiency – IRCC aims to streamline work permit applications, improving overall service for applicants.

How to Apply?

Applicants can submit their work permit requests through the International Mobility Program (IMP). Temporary resident visa-exempt individuals may also apply at a port of entry, though online submission is recommended for faster processing.

What Happens to Employer-Specific Work Permits?

  • Applications submitted before October 3, 2024, will still be processed under the previous employer-specific permit system.
  • These applicants will not be required to submit a new letter of support or commitment certificate from their designated entity.

What This Means for Entrepreneurs Moving to Canada

The transition to open work permits is a significant step in making Canada’s Start-up Visa programmore entrepreneur-friendly. By allowing applicants to explore additional employment options, the government is ensuring that start-up founders have the flexibility needed to succeed in their ventures.

With this update, IRCC continues to refine its immigration policies, making Canada an even more attractive destination for innovative entrepreneurs worldwide.
